Tentative ruling orders clerk to accept rejected Hanson recall petitions
April 11, 2012 — Visiting Lassen County Superior Court judge Charles H. Ervin issued a tentative ruling Wednesday, April 10 approving a writ of mandate to compel Lassen County Clerk Julie Bustamante to accept 70 recall petition sheets she said she had previously rejected.
Bustamante rejected the petition sheets because the proponents seeking to recall Lassen County District 5 Supervisor Jack Hanson had used a form with a misspelling of a proponent’s name on a form she had told the recall proponents not to use. The proponents allege Bustamante approved the form with the error.
Ervin characterized the misspelling as “a trivial error” and issued a writ of mandate to the clerk “directing and compelling” her “to accept and authenticate” the 70 recall petition sheets and count the signatures.
If the recall proponents collected at least 594 valid signatures, the clerk should move the recall process to its next step.
Ervin’s ruling is tentative, and he will accept five minutes of oral argument in the case, if desired, at 10 a.m. Tuesday, April 16 in Department 3 of the Lassen County Justice Center — otherwise the tentative ruling will become the court’s final ruling.
