PROPOSED RENEWAL OF TITLE V PERMIT
Pursuant to Rule 7:5 Administrative Procedures for Sources of the Lassen County Air Pollution Control District Rules and Regulations, the Air Pollution Control Officer (APCO) has made a preliminary decision to issue a renewed Operating Permit under Title V of the Federal Clean Air Act Amendments of 1990 to HL Power Company, which is an electrical power generation facility located at 732-025 Wendel Road, Wendel, CA 96136. Major facilities are required to obtain operating permits under Title V of the 1990 Clean Air Act Amendments, the Federal Operating Permit Program and the District's Regulation VII - Permits to Operate for Sources Subject to Title V of the Federal Clean Air Act Amendments of 1990. This permitting action does not involve an emission change for the facility.
The public may inspect the proposed permit at the Lassen County Air Pollution Control Office, located at 720 South St., Susanville California, 96130.  In addition, a statement that sets forth the legal and factual basis for the proposed permit conditions is available upon request.   
Written comments regarding the proposed decision may be submitted to Lassen County Air Pollution Control District within a period of thirty (30) days of the date of this notice. Any comments received will be considered prior to the final determination by the APCO to issue the permit.
A public hearing to receive oral comment on this proposed decision has not been scheduled, but one may be requested by submitting a written request to the District within thirty (30) days of the date of this notice. A written request of a public hearing must include the requester's name, mailing address, and a statement of the reasons for requesting a public hearing. Grounds for requesting a public hearing should be limited to issues relevant to District's Regulation VII - Permits to Operate for Sources Subject to Title V of the Federal Clean Air Act Amendments of 1990.  If a public hearing is to be held, the District will provide thirty (30) days notification prior to holding the requested public hearing.

The Lassen County Board of Supervisors solicits the aid of the general public in consideration of the following item:
Project:    Public Hearing: The Lassen County Board of Supervisors will consider adopting an ordinance authorizing Lassen County to join the Partnership HealthPlan of California Commission, a multi-county commission that has created a managed health care plan for Medi-Cal recipients, allowing the implementation of a county organized health system as authorized by Welfare and Institutions Code ¤ 14087.54. The Commission will negotiate an exclusive contract with the California Department of Health Care Services authorizing the expansion of the Partnership HealthPlan of California into Lassen County on or about September 1, 2013.

On July 10, 2013, Forest Supervisor Jerry Bird of the Lassen National Forest signed a Decision Notice and Finding Of No Significant Impact for the Reading Project Environmental Assessment (EA). The 10,914-acre Reading project area is bounded by the Reading Fire perimeter to the north, west, and east excluding Fruit Growers Supply Company, and the Lassen Volcanic National Park to the south.  The decision authorizes the implementation of treatments described under the Proposed Action (Alternative 1) of EA.  Treatments include the removal of fire-affected trees on 3,561 acres, removal of danger trees along National Forest System roads on 642 acres, snag research on 75 acres, and reforestation on 4,273 acres. Road treatments include upgrading 0.25 miles of existing unauthorized routes to maintenance level 1 and adding them to the National Forest Transportation System and building two miles of temporary roads.

Implementation:
An Emergency Situation Determination (ESD) request was submitted to the Chief of the Forest Service on April 12, 2013 for the Reading Project pursuant to 36 CFR 215.10. The request for an Emergency Situation Determination was granted by US Forest Service Chief Thomas L. Tidwell on July 3, 2013. Implementation may begin immediately and will be concurrent with the appeal period described above. Accordingly, two timber sales associated with this project will be advertised concurrent with the date of publication of the legal notice announcing this decision in the paper of record (Lassen County Times). A Public Hearing will be held on Tuesday, July 23, 2013 at 5:30 PM in the Lassen Municipal Utility District Board Room at 65 S. Roop Street, Susanville, CA.  This hearing is being held in compliance with Government Code Section 6066.  The preceding will consider updating the Power & Delivery Cost Analysis ("PDCA") Rate Schedule to clarify language to coincide with the current practice for calculating rate adjustments.

COUNTY MEDICAL SERVICES PROGRAM GOVERNING BOARD
NOTICE IS HEREBY GIVEN that the County Medical Services Program Governing Board (Governing Board) will hold two (2) public hearings to consider proposed program changes that will result in the expiration and termination of the Governing Board's pilot project, Path2Health, and elimination of eligibility for the County Medical Services Program (CMSP) and Path2Health program services for certain individuals and the elimination and reduction of certain health care services currently provided by CMSP and Path2Health; to consider the adoption of proposed amendment to regulations of the Governing Board concerning CMSP and Path2Health; and, to consider all evidence and testimony for or against the approval and adoption of the proposed program changes and Governing Board regulations.  
At the day, hour, and place of the hearing, any and all persons having any comments on or objections to the proposed program changes or amendment to regulations may appear before the Governing Board and be heard.  These public hearings will be held at the following dates, times and locations:

    CMSP and Path2Health provide health coverage to low-income uninsured adults in thirty-five California counties.  These counties include Alpine, Amador, Butte, Calaveras, Colusa, Del Norte, El Dorado, Glenn, Humboldt, Imperial, Inyo, Kings, Lake, Lassen, Madera, Marin, Mariposa, Mendocino, Modoc, Mono, Napa, Nevada, Plumas, San Benito, Shasta, Sierra, Siskiyou, Solano, Sonoma, Sutter, Tehama, Trinity, Tuolumne, Yolo and Yuba. The Governing Board provides policy direction for these programs. As a part of this responsibility, the Governing Board sets program eligibility requirements, determines the scope of covered health care benefits, and sets the payment rates paid to health care providers participating in CMSP and Governing Board pilot projects, including Path2Health. These public hearings by the Governing Board are being conducted to consider evidence and testimony regarding proposed changes in eligibility, reductions in or elimination of specified health care services, and proposed changes to Governing Board regulations.  
The proposed reductions of specified eligibility for CMSP and Path2Health, a two-year Low Income Health Program (LIHP) pilot project, and certain health care services provided by CMSP and Path2Health are necessitated by: (a) changes in federal and state law that expand health coverage for low-income adults up to 138% of the federal poverty level under the Medi-Cal program and provide subsidized health coverage for uninsured persons up to 400% of the federal poverty level under Covered California, a publicly funded subsidized health coverage program; (b) the end of the State of California's Section 1115 Medicaid "Bridge to Reform" Waiver authority for establishment of LIHPs, including Path2Health, on December 31, 2013; and, (c) a reduction in overall funding for CMSP beginning January 2014 that will result from the loss of State Health Realignment funding (composed of State Sales Tax and Vehicle License Fee revenues) for CMSP, as a result of changes adopted in the FY 2013-14 State Budget.  
The proposed changes would be effective on or after January 1, 2014, with the exception of the expiration and termination of Path2Health and elimination of eligibility and enrollment for individuals on Path2Health and CMSP that are otherwise eligible for Medi-Cal and Covered California, which would be effective on December 31, 2013, and include the following:
Proposed Program Changes Effective on December 31, 2013
(1) Expiration and Termination of Path2Health and Elimination of Eligibility and Enrollment for Individuals on Path2Health and CMSP That Are Otherwise Eligible for Medi-Cal and Covered California.
Under the Governing Board's LIHP pilot project, Path2Health, the Governing Board made certain changes that resulted in the expansion of program eligibility and certain behavioral health benefits for a two-year period only, beginning January 1, 2012, and ending December 31, 2013.  In addition, the Governing Board continued operation of CMSP.  Funding for Path2Health has been provided by funds from counties participating in CMSP, funds allocated to CMSP from State Health Realignment revenues, and federal Medicaid matching funds.  Federal Medicaid matching funds for Path2Health will not be available for services delivered after December 31, 2013.  Funding for CMSP has been provided by funds from counties participating in CMSP and funds allocated to CMSP from State Health Realignment revenues.  In addition, under state and federal law, beginning January 1, 2014, individuals enrolled in Path2Health will be eligible for Medi-Cal and certain individuals enrolled in CMSP will be eligible for Medi-Cal or Covered California.   
Currently, certain individuals are eligible for and enrolled in Path2Health and CMSP.  With the end of Path2Health on December 31, 2013, and the expansion of eligibility for health coverage under Medi-Cal and Covered California beginning January 1, 2014, it is proposed that administrative actions be taken by the Governing Board and participating CMSP county eligibility departments to assure that individuals that are otherwise eligible for Medi-Cal and Covered California on or after January 1, 2014, are transitioned to those programs.  To effectuate this transition, it is proposed that Path2Health end on December 31, 2013, and eligibility be terminated that same day for all individuals enrolled in Path2Health during December 2013.  Further, it is proposed that CMSP eligibility be terminated on December 31, 2013, for those individuals enrolled in CMSP during December 2013 that are likely to be eligible for Medi-Cal or Covered California on January 1, 2014.  Finally, it is proposed that should the Medi-Cal expansion or Covered California not take effect on January 1, 2014, that those individuals enrolled in Path2Health and CMSP during December 2013 and whose eligibility for those programs were terminated on December 31, 2013, be provided the opportunity to reapply for CMSP in accordance with CMSP eligibility requirements and benefit coverage in effect at that time.
The Governing Board estimates that these proposed changes will affect up to 60,000 persons enrolled in Path2Health and up to 10,000 persons enrolled in CMSP.  It is estimated up to $160 million in county funds will be saved as a result of these changes.  These proposed changes will take effect on December 31, 2013.
Proposed Program Changes Effective on or after January 1, 2014
(1) Limitation of CMSP Eligibility to Individuals That Are Not Otherwise Eligible for Other Publicly Supported Health Coverage, including Medi-Cal and Covered California.  
With the end of Path2Health on December 31, 2013, and with the expansion of eligibility for health coverage under Medi-Cal and Covered California beginning January 1, 2014, it is proposed that ongoing administrative actions be taken by the Governing Board and participating CMSP county eligibility departments to assure that individuals that are otherwise eligible for other publicly supported health coverage, including but not limited to, Medi-Cal and Covered California, are required to seek enrollment in those programs as a condition of applying for eligibility for CMSP and to enroll in Medi-Cal and Covered California, or other publicly supported health coverage, in lieu of enrolling in CMSP whenever appropriate.  The Governing Board estimates that these proposed changes will affect up to 12,000 persons annually.  The cost savings associated with this proposal are indeterminable at this time. These proposed changes will take effect on January 1, 2014.
(2) Certification Period for CMSP Eligibility Limited to Three (3) Months.  Currently, individuals that are determined eligible for CMSP under aid codes 85, 88 and 89 have a term of enrollment that is six (6) months.  At the end of this enrollment term, these persons are required to reapply for CMSP to continue eligibility for the program.  It is proposed that individuals that are determined eligible for CMSP under aid codes 85, 88 and 89 have a term of enrollment that is three (3) months beginning on or after January 1, 2014.  Under this proposed change, the enrollment term for individuals that are eligible for aid code 50 (emergency services only) will not be changed and will continue to be limited to two (2) months.  The Governing Board estimates that this proposed change will affect up to 8,000 persons.  The cost savings associated with this proposal are indeterminable at this time.  These proposed changes will take effect on or after January 1, 2014.
 (3) Elimination of Optometry Benefits, Including Eye Glasses.  Currently, CMSP and Path2Health enrollees may receive optometry services from a licensed optometrist and eyeglasses are a covered service, with certain limitations.  It is proposed that optometry services provided by a licensed optometrist and eyeglasses be eliminated from CMSP benefit coverage beginning on January 1, 2014. The Governing Board estimates that these proposed changes will affect up to 12,000 persons annually.  The cost savings associated with this proposal are indeterminable at this time.  This proposed change will take effect on January 1, 2014.
(4) Elimination of Mental Health and Substance Use Disorder Counseling Service Benefits.  Currently, CMSP and Path2Health enrollees may receive specified assessment and counseling services.  These services include one mental health assessment and up to 10 individual mental health counseling services; and, one substance use disorder assessment, up to two individual substance use disorder counseling services, and up to 20 group substance use disorder counseling services.  It is proposed that these mental health and substance use disorder services be eliminated from CMSP benefit coverage beginning on January 1, 2014.  The Governing Board estimates that these proposed changes will affect up to 12,000 persons annually.   The cost savings associated with this proposal are indeterminable at this time. These proposed changes will take effect on January 1, 2014.
(5) Reduction of Dental Benefits to Emergency Dental Services Coverage Only.  Currently, CMSP and Path2Health enrollees may receive a wide range of dental services under a comprehensive scope of dental benefits.  It is proposed that the CMSP benefit coverage scope of dental benefits be restricted to a set of services that address emergency dental service needs only beginning on January 1, 2014.  The Governing Board estimates that these proposed changes will affect up to 12,000 persons.  The cost savings associated with this proposal are indeterminable at this time. This proposed change will take effect on January 1, 2014.
(6) Elimination of Benefit Coverage Outside of the State of California.  Currently, CMSP and Path2Health enrollees may receive covered health care services provided by health care providers in states outside of California when such providers are located within 30 miles of the California border and have contracts to provide services to CMSP and Path2Health enrollees. Further, Path2Health provides benefit coverage of emergency medical services and post stabilization services outside of the State of California in any of the U.S. States and U.S. Territories.  In addition, currently, CMSP provides benefit coverage of emergency medical services in states outside of California when emergency medical services are provided by a non-contracting provider within 30 miles of the California border.  It is proposed that all CMSP benefit coverage, including coverage of emergency medical services, be restricted to services provided only in the State of California beginning on January 1, 2014.  The Governing Board estimates that this proposed change will affect up to 12,000 persons.  The cost savings associated with this proposal are indeterminable at this time. This proposed change will take effect on January 1, 2014.
Proposed Governing Board Regulation Amendments Effective on January 1, 2014.
(1) Adoption of Amended Regulations for Governing Board.  The Governing Board proposes to adopt amended regulations that clarify various conditions of CMSP eligibility and benefit coverage.  These include: (a) clarifying that CMSP is specifically intended and designed to be the payor of last resort and provide health benefit coverage only to the extent that persons meet CMSP eligibility requirements and are not otherwise eligible for other publicly funded health programs, including but not limited to Medi-Cal or Covered California,  or are enrolled in any other health program;  (b) clarifying that applicants for CMSP shall be required to cooperate in the completion of application and pursue eligibility for Medi-Cal, Covered California and other available publicly funded health coverage programs to obtain or continue eligibility for CMSP; (c) authorizing CMSP to seek recoveries from third parties, including but not limited to Medi-Cal, Covered California and other public or private health programs; and (d) making conforming regulation amendments to describe or define benefit coverage and limitations on benefit coverage as otherwise described in this notice. The proposed changes to Governing Board regulations will result in indeterminable savings to CMSP.  The Governing Board estimates that the proposed changes will affect up to 12,000 persons annually.  These proposed changes will take effect on or after January 1, 2014.
