Ordinance No. 10-0973

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUSANVILLE, APPROVING MUNICIPAL CODE AMENDMENT OF SECTIONS 17.12.060

 AND 17.104.130 REGARDING SITE DEVELOPMENT STANDARDS FOR PARKING IN RESIDENTIAL ZONE DISTRICTS (GARAGE CONVERSIONS)

The City Council of the City of Susanville does hereby ordain as follows:

                  Section 1:

                  Section 17.12.060.D. “Parking” of the Susanville Municipal Code is hereby amended to read as follows:

‘1.Parking requirements as specified in Sections 17.100.010--17.100.160. For each newly constructed single-family residence, two covered parking spaces in a carport or garage. Each space shall be a minimum of ten (10) feet in width and twenty (20) feet in depth of unobstructed area. Washing machines, dryers, water heaters, stairways, supporting columns, steps or other obstructions shall not be located within the required parking space.

2.Garage Conversions. Existing garages to be converted to non-parking uses shall comply with the requirements of Section 17.104.130.

Section 17.104.130 “Garage Conversions” of the Susanville Municipal Code is hereby added to read as follows:

‘17.104.130Garage Conversions

An existing residential garage may be converted to an alternate use allowed by zoning if the following requirements are met:

A.An administrative permit and a building permit are issued.

B.The equivalent number of parking spaces being converted to non-parking uses shall be provided elsewhere on the lot. These spaces may be covered or uncovered and shall be located on a paved or graveled surface. This area can include an existing driveway or parking pad but cannot include conversion of landscaped areas between the primary dwelling and the street in the front yard setback. Tandem or side-by-side parking is allowable.

C.The conversion must be designed to be architecturally compatible with the rest of the residential structure, as determined by the Building Official.

D.All applicable building codes apply to the conversion.

E.Exceptions to these requirements require a residential use permit.’

Section 2. Publication, Severability and Effect

                     1.The City Clerk shall, within fifteen (15) days after its passage, cause this Ordinance to be published at least once in the Lassen County Times, a newspaper of general circulation, printed, published and circulated within the City.

                     2.If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance, it being expressly declared that this ordinance and each section, subsection, sentence, clause or phrase hereof would have been prepared, proposed, adopted, approved and ratified irrespective of the fact that any one or more other sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.

                     3.  This Ordinance shall take effect upon the thirty-first day after its passage.

NOTICE OF PUBLIC HEARING AND

 PUBLIC REVIEW PERIODPROPOSED REVISION OF TITLE V PERMIT

Pursuant to Rule 7 of the Lassen County Air Pollution Control District Rules and Regulations, the Air Pollution Control Officer (APCO) has made a preliminary decision to issue an Operating Permit for the reactivation of the former Sierra Pacific Industries (SPI) Biomass Power Plant located on Sunkist Drive in Susanville, CA.  The current project owner is HENRI Susanville, LLC (HENRI).

The Susanville biomass power plant is a 12.5MW (net) facility built by SPI in 1984.  It has operated under Title V of the Federal Clean Air Act Amendments of 1990.  Title V provides for the establishment of operating permit programs for stationary sources which emit regulated air pollutants.

HENRI proposes to make significant upgrades to the facility’s emission control equipment and restart the plant under the terms specified in the 2003 Title V permit renewal. Those improvements include:

         1.      Replacement of Cooling Tower,

2.Replacement of CEMs and COMs systems,

3.Improvement of Overfire Air System, 

4.Improvement to the ESP by replacing sonic horns with rappers,

5.Installation of new software, installation of new natural gas start-up burner, 

6.Installation of SNCR system to control NOx emissions.

These improvements would allow the facility to operate at lower emission levels under the re-issued permit than the original plant could achieve.  Accordingly, the terms of the draft permit incorporate measures to ensure a greater level of emission control.

In 2003, the Lassen County Air Pollution Control District conducted a public review of the proposed renewal, in accordance with the provision of Rule 7, and provided notice to the U.S. Environmental Protection Agency.  Amendments to the draft permit suggested by EPA have been incorporated into the presently contemplated permit.  Additional information may be obtained from the Lassen County Air Pollution Control District office at (530) 251-8309.

Written comments regarding the proposed decision may be submitted to Lassen County Air Pollution Control District, 707 Nevada Street, Susanville, CA 96130, by 5:00 pm February 26, 2010. Any comments received will be considered prior to the final determination by the APCO to issue the permit.
